Terms of Use — Healthcare Professionals

1. Access requirements

• The healthcare professional represents that they are duly registered with the professional board (ordre) or register to which they belong (including the RPPS, the French national health professional register) and authorized to carry out prevention check-ups under the Mon bilan prévention program, France’s national prevention check-up program.
• Access is through an individual, named account; sharing login credentials is prohibited. The professional is responsible for all activity carried out from their account.
• Use of the service is free for the partner healthcare professional. Services invoiced to organizations (institutions, supplementary health insurers, companies) are subject to separate contractual terms.

2. Your pathway

• Before the consultation: depending on the pathway, you access the patient’s structured file (questionnaire responses, risk factors, priorities). Summaries and preparatory documents may be generated automatically; their generation does not constitute an individual clinical validation.
• During the consultation: you conduct your clinical examination and assessment; the structured file is a documentation aid and does not replace them.
• Prevention plan: you review the preparatory materials, write or adjust the Personalized Prevention Plan (PPP), then validate and sign it as part of the patient’s care. An automatically generated document does not constitute validation or signature on your part.
• Referral: the arrangements for transmission to the patient’s regular doctor (médecin traitant) and the patient’s rights are described in the privacy policy.
• Coordination: if the patient has consented, their results may be shared with the relevant healthcare professionals at the center to implement prevention initiatives.

3. Clinical responsibility

The healthcare professional remains solely responsible for their clinical decisions, diagnoses, and prescriptions. They are the author and signatory of the PPP. The structured file and the materials generated by the service are a documentation aid and do not replace either the clinical examination or professional judgment. Sokrate does not make any diagnosis or issue any prescription.

4. Obligations

• access only the data of patients under their care that is strictly necessary to write the PPP — all file access is subject to full audit logging;
• comply with professional secrecy and their ethical obligations;
• not extract, reuse, or disclose data outside the care of the patient concerned;
• promptly report to Sokrate any security incident, anomaly, or error found in a file (dpo@sokrate.com), without sending clinical data by ordinary email;
• keep their professional profile information up to date.

5. Personal data

When the check-up is carried out on behalf of a professional or a health center, that professional or center is the data controller and SOKRATE SAS acts as data processor (Article 28 of the GDPR), under a data processing agreement. Other processing activities are described in the Privacy Policy. The main health record managed by Sokrate is hosted in France on Google Cloud Platform, within the scope of its HDS-certified services (French health data hosting certification). Service providers and any transfers related to other processing activities are presented in that policy.

6. Suspension and termination

Sokrate may suspend or terminate access in the event of a breach of these terms, loss of professional authorization, or for security reasons. The professional may stop using the service at any time. For all other matters (intellectual property, liability, governing law), the Terms of Service apply.
