Terms of Service

1. Purpose and acceptance

The purpose of these Terms is to set out the conditions under which SOKRATE SAS (“Sokrate”) makes its services available and under which the user accesses them. Accessing the service constitutes full and unreserved acceptance of these Terms. If you do not accept these terms, you must not use the service.

2. Definitions

• Service: all features offered by Sokrate (prevention questionnaire, data structuring, patient area, practitioner area, support and follow-up).
• Patient: any person completing or preparing a prevention check-up through the service.
• Healthcare professional: a doctor, nurse, pharmacist, midwife, or other authorized professional using the service in the course of their practice.
• PPP: Personalized Prevention Plan (Plan Personnalisé de Prévention), written and signed by the healthcare professional.

3. Description of the service

Sokrate is a prevention support infrastructure integrated into the care pathway, designed to facilitate the preparation and follow-up of the prevention check-up under the official Mon bilan prévention program, France’s national prevention check-up program. The service includes in particular:

• an adaptive health questionnaire (Sokrate 360);
• structuring of responses and preparatory documents that may be generated automatically using artificial intelligence tools based on prevention guidelines; these documents do not constitute an individual clinical validation;
• provision of a structured file to the healthcare professional, who writes, adjusts, and signs the PPP;
• a secure patient area providing access to the plan and resources;
• as they are activated, additional optional features — such as linking connected devices at the patient’s initiative — under the conditions described in the Privacy Policy;
• support and follow-up provided by a medical coordinator.

4. Nature of the service — medical disclaimer

Sokrate does not make any diagnosis or issue any prescription. The service provides an educational framework and structuring support. Clinical decisions rest exclusively with the healthcare professional, who remains the author and signatory of the PPP and is solely responsible for its content.

The information provided is not a substitute for a medical consultation. The service is not intended to handle emergencies. In a medical emergency, call 15 (SAMU, French emergency medical service) or 112. A data point is not a diagnosis: it must be interpreted in a clinical context.

5. Access and pathway

Depending on the pathway, the patient accesses the questionnaire from their account or following an invitation from their healthcare professional or health center. Account creation and login procedures are specified in the area being used. Summaries and preparatory documents may be generated automatically from the responses. They do not constitute a Personalized Prevention Plan validated and signed by a professional. During a consultation, the professional reviews these materials and adjusts and validates the PPP. The recipients of the data and the sharing arrangements are described in the privacy policy.

Access to certain features requires an account with accurate, up-to-date information. You are responsible for keeping your login credentials confidential and for all activity carried out from your account. 6. Financial terms

The prevention check-up falls under the Mon bilan prévention program and is, as such, covered by French National Health Insurance (Assurance Maladie) under the conditions in force. Use of the service is free for the patient and free for the partner healthcare professional. Any services invoiced to partners (institutions, supplementary health insurers, companies) are subject to separate contractual terms.

7. User obligations

The user agrees to:

• provide accurate and truthful information;
• use the service in accordance with its intended purpose and applicable regulations;
• not compromise the security, integrity, or proper operation of the service;
• not access data they are not authorized to access, nor misuse such data;
• use the designated health areas for clinical data, and not send such data through general contact forms or by ordinary email;
• respect the rights of third parties, including intellectual property rights.

8. Personal data

The processing of personal data is described in our Privacy Policy. The main health record managed by Sokrate is hosted in France on Google Cloud Platform, within the scope of its HDS-certified services (French health data hosting certification). Processing carried out by other service providers and information about data transfers are presented in that policy.

9. Intellectual property

The service, its components, its content, and its trademarks are protected and remain the exclusive property of SOKRATE SAS or its partners. No intellectual property rights are assigned to the user. A personal, non-exclusive, non-transferable license to use the service is granted solely for the duration of use of the service. Health data entered by the patient remains theirs.

10. Liability

Sokrate uses reasonable means to ensure the availability and security of the service, without guaranteeing that it will be entirely free from interruptions or errors. Sokrate shall not be held liable:

• for clinical decisions, diagnoses, or prescriptions, which are the sole responsibility of the healthcare professional;
• in the event of improper use of the service or inaccurate information provided by the user;
• in the event of force majeure or the act of a third party.

To the extent permitted by law, Sokrate’s liability is limited to direct and foreseeable damages. Nothing in these provisions excludes any statutory liability that cannot be excluded.

11. Term, suspension, and termination

These Terms apply for the entire period during which the service is used. The user may stop using the service and request deletion of their account at any time. Sokrate may suspend or terminate access in the event of a breach of these Terms or for security reasons, while respecting the user’s rights over their data.

12. Changes to the Terms

Sokrate may amend these Terms to reflect changes to the service or to regulations. The applicable version is the one in force at the time of use. The date of the last update appears at the top of this page.

13. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, the user is invited to contact Sokrate at contact@sokrate.com in order to seek an amicable solution. In accordance with Articles L.612-1 et seq. of the French Consumer Code, consumers may refer the matter, free of charge, to the consumer mediator designated by Sokrate: CNPM — Médiation de la Consommation (cnpm-mediation-consommation.eu) [postal address to be added from the membership agreement]. If no amicable resolution is reached, the French courts shall have jurisdiction.
